Standard durations of lease contracts

6 Months Maximum

The lease will end, as of right, at the end of the period without notice having to be notified in advance. This lease cannot be terminated early. If the tenant continues to occupy the premises without opposition from the lessor, the lease is deemed to have been concluded for a period of 9 years, from the date on which the initial lease came into force. In this case, the rent and other conditions agreed in the initial lease remain unchanged.

By mutual agreement and in writing, the parties may extend the lease under the same conditions. The lease can be extended several times. The total duration of the lease can in no case exceed 3 years.

More than 6 months and less than 3 years.

The lease is concluded for a fixed period and ends on the agreed date provided that one of the parties gives notice to the other by registered letter, at least three months before the expiry date. If the notice has not been served on time or if the tenant continues to occupy the premises without opposition from the lessor, the lease is deemed to have been concluded for a period of 9 years, from the date on which the initial lease is entered into force. In this case, the rent and other conditions agreed in the initial lease remain unchanged.

It can be terminated at any time by the lessee, subject to three months' notice and compensation equivalent to one month's rent. The lessor may not terminate the short-term lease in advance until after the first year of rental, and under the conditions provided for in article 237, § 2, of the ordinance of 27.07.2017 (personal occupation) by giving notice of 3 months and compensation equivalent to one month's rent.

Nine years

It ends at the expiration of the agreed period with notice notified by either party at least six months in advance.

In the absence of notice within this period, the lease is extended each time for a period of three years, under the same conditions.

The lessor may terminate the lease at any time by giving 6 months’ notice in advance if he intends to occupy the property personally. The lessor may terminate the lease at the end of the third or sixth year if he intends to carry out major work in the leased property, meeting the conditions defined by article 237 paragraph 3 of the Brussels Housing Code, with 6 months' notice. The lessor may terminate the lease at the end of the third or sixth year with 6 months’  notice and payment of the compensation provided for in the Code.

For his part, the Lessee may terminate the lease at any time, subject to a three-month leave, and the payment of compensation equal to three months, two months or one month's rent depending on whether the lease ends during the 1st, 2nd or 3rd year.

When the Lessor uses his early termination option, the Lessee can also terminate the lease at any time with one month's leave, without compensation.
